  Terms & Conditions to Clients

1. Booking Models: Please read these T & C's before booking Models. All bookings are subject to these T & C's although Contract Models (the Agent) reserves the right to negotiate within the structure of these T & C's without prejudice to any prior or subsequent negotiation or agreement. Models introduced by the Agency to a Client or his agent must be booked through the Agency unless the Model has resigned from the Agency.

2. Hours. The normal hours for a booking are between 0900 and 1800 hours. A day’s work is 8 hours (including a 1 hour lunch break); a half day is 4 hours and the minimum booking is 2 hours. All other working hours are by negotiation only.

3. Bookings. All parties concerned in booking a Model must consult the Agent before quoting fees to the Client. Fees will be agreed at the time of booking. Fees will cover usage in the UK only for a period of one year from the shoot date. Fees will cover the type or types of usage specifically agreed at the time of booking, but no other. If there is to be additional usage the Client must inform the Agent in advance and negotiate a further fee. If a further fee is not agreed in advance of the additional usage, the Agent is entitled to fix a fee for the additional usage at a sum considered reasonable by the Agent, which the Client will pay on receipt of an invoice. Fees will be charged for each type of usage for periods of one year each. VAT will be added as appropriate to all fees in accordance with the laws of the UK. All fees are to be agreed by the agency and only with the agency. The Model receives 62.5% and the Agency 37.5% of the total fee of the invoice (excluding expenses and VAT). For Equity contracts and repeat fees the respective percentages are 80% and 20%.

4. Travel time will be charged at a rate to be agreed prior to booking in respect of travel outside a five mile radius from Charing Cross

5. Fees for fittings are charged at half the hourly rate with a minimum of £50 per hour.

6. Mixed Agency bookings: In the event that Model(s) from another agency are working on the same assignment providing the same services as Model(s) from the Agency but at a higher fee, the Agency reserves the right to charge at an identical rate.

7. Material Produced. It is an integral part of a booking agreement that the Client will provide a copy in reasonable format of the finished work of the assignment.

8. Restrictions. An exclusion fee is to be negotiated when a Client requires a Model to work in connection with a product on the basis he/she is then precluded from doing work in connection with competing products. It is the Clients responsibility to check product bookings with the Agent for conflicts prior to booking the Model. Unless such an exclusion fee is negotiated and paid, then, if a Model advertises a product, he/she is able to work for any competitor.

9. Meals. The Client is responsible for the payment and provision of Models meals on all bookings of over 4 hours + duration.

10. Weather Permitting Bookings. i. First cancellation at half fee (providing the Model is rebooked) unless the Model arrives at a booking through the Clients failure to cancel it in time then full fee is payable. ii. Second cancellation at full fee.

11. Cancellations. Providing a cancellation is notified to the Agent in writing two working days before the booking, then only half fee will be payable. If notice is received one working day prior to the booking, then the full fee remains payable.

12. Provisional bookings will be automatically cancelled if they are not confirmed within 24 hours of the proposed booking or if a definite booking is offered, then a provisional cannot be confirmed.

13. Payment on all invoices must be made before any usage, and at latest within 30 days of invoice. Interest of 3% per month will be added thereafter. VAT is charged in accordance with the laws of UK. The Client responsible for commissioning the work will be invoiced and will be responsible for payment. If payment is not received from the commissioner, then we will seek payment from the commissioners client, usually the manufacturer of the goods or the product advertised or promoted known as the END client. No use of images is permitted unless and until all relevant fees have been paid.

14. Copyright & Photographer Information. The photographer is not entitled to use any of the images he or she takes, for any usage other than his or her personal portfolio beyond that agreed and paid for through the Agent. The photographer, to his extent, agrees to restrict use of his copyright and, if Agency Client is not the photographer, the Client is to draw these T & C's to the attention of the photographer and obtain his agreement before the shoot commences. The photographer is not entitled to use test and experimental photographs for commercial purposes of any kind.

15. Complaints. Any cause for complaint should be reported immediately it arises. Complaints will not be considered in retrospect.

16. Insurance. It is the Clients responsibility to arrange insurance of all kinds for an assignment. This includes personal and third party liability insurance at an assignment plus indemnity in the event that the Model is unable to attend for whatever reason.

17. Exclusion of liability. Whilst every endeavor is made to provide a satisfactory and efficient service to the Client, the Agent is not responsible for the conduct of any Model and is not liable for any loss of profits or other damages including damage to property or persons suffered either directly or indirectly as a result of any act or omission of any Models introduced by the Agent, nor is the Agent liable for any loss of the same nature alleged to have been caused by the Agent.

18. Acceptance. All bookings of a Model made by the Client are made on the basis that these T & C's are incorporated in the contract between the Client and the Agent on behalf of the Model. If there is any conflict between any Terms the Client might seek to contract on, these Terms prevails. These T & C's take precedence over any T & C's that may be received from the Client (even if those T & C's have a clause similar to this) unless agreed prior to the assignment.

All Contracts and these Terms and Conditions shall be governed by English Law and the Parties consent to the exclusive jurisdiction of the English courts in all matters regarding them.


  Agency Terms to Model

1. AVAILABILITY: You agree to be available for modeling and acting work. You will carry out that work on the terms agreed on your behalf between Contract Models and the client.

2. ACCEPTANCE OF WORK & SIGNING DOCUMENTS: To clients CONTRACT MODELS undertakes to circulate a book or email your photographs with work relevant details. We operate on the basis that you are available for work at any time. You must inform us if you are unavailable for a period of a day or longer. You must also inform us if there are certain times of the day, or days of the week when you are unavailable. We must be informed of any particular clients for whom you do not wish to work. Once an offer in respect of your modeling services has been accepted by a client you will faithfully carry out all your obligations, in accordance with the contract made between us and the client on your behalf. We will negotiate fees and sign all relevant written documents on your behalf.

3. MODEL RELEASE FORM: You should not sign a model release form or any other documents presented to you on a shoot until a copy has been read and authorized by us, and you are authorized to sign it, by us

4. CHANGE OF DETAILS
Your Appearance You must inform us of any changes to your appearance. It is your responsibility to ensure our records are always kept up to date, for example details of your measurements, hair colour or length, suntan, scars or damage to nails. You should periodically forward new photographs to us. The more shots we have, the greater the chance of us, finding work on your behalf.

Your Address You must inform us of any changes to your address otherwise you will be liable to pay any cancellation fees incurred (cheque cancellation fee, for example)

5. PUNCTUALITY: When you are booked for a job you must arrive early. The time of booking given to you by us is the time you are to be ready for the camera. You must allow time for hair and make up, etc. If you are late costs may be incurred, for example additional fees payable to models, photographer and other parties involved with the shoot. If you are attending a booking and are running late you must call us so the client can be informed.

6. TRAVEL: If a client is to pay for your travel expenses you will be informed prior to the engagement; otherwise you must pay.

7. CLOTHES AND ACCESSORIES: It is essential that you have a selection of clothes and accessories available to enable you to undertake standard assignments in your style of modeling work.

8. MAKE UP: Unless otherwise advised by us you must arrive at the studio or location of the shoot either fully made up or early, allowing sufficient time for make up before the shoot start time. You should have basic items such as face powder, hair accessories, etc, available even if you have been informed that the client will provide a make up artiste.

9. OVERTIME: When a shoot runs into overtime you should continue with the shoot, make a note of the time of completion and give the information to us as soon as possible, no later than 5pm on the next working day or you cannot claim extra payment.

10. AFTER THE SHOOT: After the shoot you should call us to report the time at which you completed the assignment. It is in your interest to do so as it assists us in preparing and forwarding the invoice to the client.

11. CASTINGS: You are not entitled to any fees or expenses for attending castings. Attend castings alone unless you obtain our prior agreement to another person attending.

12. ATTENDANCE AT SHOOTS & INDEMNITY FROM YOU TO US: Attend shoots alone unless you obtain our prior consent to another person attending. It is your duty to carry out the booking to the best of your ability and in accordance with the terms and conditions set out in this document. In the event of your failure to do so you agree that you are bound by such terms as may be re-negotiated between us and the client. You agree to pay us the full amount of any claims, including associated charges that may be made against us as a result of any failure by yourself to carry out the booking professionally: be that a breach of the terms agreed between us and the client, your negligence, your cancellation of the booking, inappropriate behavior at the shoot or otherwise by you We will not settle any claims without first fully discussing the circumstances with all parties.

13. OTHER AGENTS: You must inform us if you are registered with other agents. If we contact you first about a job or potential job and then another agent contacts you about the same job or potential job you may accept a booking only through us. If we ask you about a job or potential job of which you have prior knowledge through another agent, please tell us immediately. Any photographs of you taken by us are not to be given by you to any other agent or to be used by any other agent for any purpose.

14. CANCELLATION: If you are unable to attend a booking because of sickness you must provide us with a doctors note. If you fail to arrive for a booking or you cancel you will lose your own fee and may be liable for the costs and fees incurred by all other parties involved in the shoot should the assignment not be able to continue as planned. You agree to indemnify us of any claim is made against us, as set out in clause 12 of these terms and conditions.

15. PAYMENT: All fees are earned on a self-employed basis. We is not responsible for the payment of tax or National Insurance on your behalf. We invoice the client direct and then pays you. You may not accept payment direct from the client. If you are offered direct payment, decline and inform us immediately. We is unable to guarantee payment and cannot be held responsible for bad debts incurred should a client default on payment. If we post a cheque to you and it does not arrive, the cheque cancellation fee charged by the Bank will be deducted from your payment. If you wish to be paid directly into your bank account please provide us with your bank details . Please note that most of our clients pay around 90 days from Invoice date, please enquire about payment via email to info@contractmodels.co.uk we can keep you updated with when payment is expected from the client.

16. PICTURES: You are not to contact the client, photographer, Design Company, or anyone else involved with any assignment to request transparencies, proofs or other photographic material. If you would like to obtain copies of your work please contact us and we will endeavor to obtain copies on your behalf.

17. DETAILS OF BOOKINGS: When we informs you of a booking by phone you must make a written note of the time and place at which you are to attend, We also emails you all booking details, including fees, dates, times, addresses.

18. COMPLAINTS: If you have a complaint about any event that may occur whilst you are on a shoot please let us know so that we may discuss the complaint with you. You should not make any complaint direct to the client, photographer, or any other person involved in the shoot. If we considers your grievance justified we will take up the complaint with the relevant authority on your behalf.

19. LEAVING OP: If you no longer want to be represented by us we require you to provide us with a signed letter stating that we are no longer without notice authorized to act as your agent. You can issue us a letter at any time. Any outstanding bookings in place at the time we receive the letter must be honored, and clause 12 remains in force. You are entitled to receive notice from us of our termination of this agreement and the length of notice will be immediate.

20. PHOTOGRAPHIC WORK 37.5%: For photographic work our commission is 37.5% of the model fee; you receive 62.5%. We charges commission only to the client.

21. TV / FILM / VIDEO 20%: For film work at 20% of the model fee; you receive 80%. We charges commission only to the client.

22. FEES QUOTED TO YOU: When we books you for a job we quote to you the amount you will receive (i.e. the 62.5% or 80% as referred to above, after our commission of 37.5% for photographic work and 20% for film work respectively); you receive this provided you comply with our terms and conditions and there are no justified complaints from the client about your services and subject to us receiving payment from the client. All fees are negotiated and confirmed at the time of each booking. they may be subject to variation (for example sometimes there has to be renegotiation of fees). For travel time, where applicable, you get 62.5% on photographic and 80% on film work. You agree to authorize us to collect money on your behalf.

23. FEES: We charge Joining fees of £5 only. This fee is refundable after your first assignment. The main reason for this is to avoid people not dedicated to modeling from joining.

24. INTRODUCTIONS: If we introduces you to a client and that results in work for you not booked through us, you should inform us, and in that event you will arrange for the client to pay us 37.5% or 20% of the model fee as applicable and if you do not do this you will pay the equivalent amount to us.

25. RELATIONSHIP: You, as a model or artiste, agree that the relationship between yourself and us is that of us acting as an Employment Agency, and not an Employment Business. The type of work you may obtain through us is photographic advertising (modeling work), television commercials, main feature or featured extra, BBC contract work, parts in feature films, pop videos, corporate videos. We supply people to the advertising, film and television industry and most jobs are obtained by first attending a casting.

26. IDENTITY: You shall provide us with proof of your identity. This shall take the form of a photocopy of your passport/driving license, which will signed and dated by yourself and witnessed, signed and dated by an authority.

27. CHANGES TO THE TERMS AND CONDITIONS: These terms and conditions may be changed from time to time.
